#1 most viewed video on CSPAN of all time has everything to do with the Tea Party

Ironically, it is the White House Daily Briefing on Tax Day 04/15/2009 the date of the Tea Party nationwide protest (video embedded below). Robert Gibbs is asked about the nationwide protest Tea Party protests a number of times. In fact Politics Daily had this to say in an article on this very briefing in a post titled Gibbs: President Looking Out for Tea-Baggers: "The Tax Day Tea Party was the hot topic at today's White House press briefing, where Press Secretary Robert Gibbs fielded 5 questions on the protest...". You can watch the briefing below which has 663,194 views as of 12/31/2010 according to the CSPAN video library. Also see Top 10 most viewed videos on CSPAN in 2010

Now here are the top ten five videos of CSPAN for the year 2010. Click on link to watch the video and views are all as of 12/31/2010 according to CSPAN's video library.

1. Senate Session for May 6 2010 (263,658 views) was the most watched. If you notice their is a section on that screen on the bottom right that says "Featured In" and lists some sites that this video was featured in and may give a hint as to why so many views. HotAir.com, a very popular conservative site, embedded the video on their site over Al Franken comments in the Session as he rises in defense of the Wall Street reform bill. For more from HotAir.com see post titled Al Franken’s long, tortured explanation of editorial-cartoon humor.

2. The Restoring Honor Rally on August 28th (253,346 views). CSPAN describes this video as "Glenn Beck, Sarah Palin, and others spoke at the Restoring Honor Rally, held at the Lincoln Memorial. Speakers focused on the conservative agenda, religious values, civil rights issues, the economy, and reducing the size and influence of government." Clearly this was the video of the year for CSPAN. Even though it comes in 2nd notice that it is 2nd by a mere 10,000 views and aired some 3 and almost 4 months after the #1 video.

3. Immigrant Farm Workers on September 24th (220,537 views). I believe this received many hits because of comedian Stephen Colbert's appearance and testimony. CSPAN describes the video as "Witnesses spoke about the American agricultural sector's reliance on foreign, and often undocumented, workers to pick fruit and vegetables on America's farms. Comedy Central's Stephen Colbert appeared in character to testify. Mr. Colbert was part of a United Farm Workers campaign calling on unemployed Americans to take jobs in the agriculture sector. As part of the program he spent a day laboring at a vegetable farm in New York in August 2010."

4. House Session of March 21st (185,682 Views). The unpopular health care bill passes. CSPAN describes this session as "The House has passed the Senate version of health care legislation by a vote of 219 to 212. The House has passed both the Senate health care legislation and the reconciliation bill. The reconciliation bill now goes to the Senate for debate and the passed Senate bill heads to President Obama for his signature."

5. Presidential Remarks at House Republican Conference (180,704 Views). This just after Scott Brown's huge upset of a win for the Senate seat in Massachusetts which gave Republicans a 41 seat minority which made it much more difficult for Democrats to pass their agenda on the American people. CSPAN describes this video as "President Obama spoke to House Republicans at their retreat in Baltimore. In his remarks he said he welcomed disagreement and debate, but called for genuine bipartisanship and asked for constructive ideas in confronting the nation's problems. Following his remarks he openly and frankly answered pointed questions from the Republican legislators. Topics ranged from health care, to energy policy, to taxes and the economy. This version does not contain the introduction of the president and has a single camera shot without showing questioners."

Like Gov. Christie of New Jersey newly elected Republican Governor of Virginia is cutting taxes and balancing the budget at the same time

Update: Here is video footage of below story.

Virginia newly elected Governor Bob McDonnell who was elected in 2009 in the same year Governor Christie of New Jersey was elected has just turned Virginia's budget woes around without raising taxes and has created a surplus. Most know that Governor Christie (seeWatch Governor Christie inspiring political story featured in 23 minute documentary for Remember November part 1 "A New Jersey") balanced the budget without raising taxes in New Jersey and New Jersey had an $11 billion dollar deficit which was the largest in the nation of any state at the time.

From CBNNews in an article titled Out of the Red: Virginia's Economic turnaround:

"As many states work to stay out of the red, Virginia is coming off of a budget surplus....

When he took office in January 2010, Virginia was just beginning to emerge from the worst economy in modern history. Gov. McDonnell began his first day in office facing a near $2 billion budget gap and a fiscal forecast that projected a $4 billion budget gap over the next two years.

His predecessor, Gov. Tim Kaine, offered a parting suggestion that included trimming $2 billion out of the state's $80 billion budget and raising taxes to generate the other $2 billion.

However, raising taxes wasn't an option for McDonnell. He had just spent the last year campaigning against tax hikes.

Instead, the conservative governor worked with Virginia's Democratic Senate and Republican House to roll back the clock four years, returning state spending levels to those of 2006....

The governor then used some old-fashioned business incentives to keep state agencies from going on their infamous year-end spending sprees that drained their budgets of any leftover money.

"We said 'Look, you save money, you'll have a 3 percent bonus.' So they saved about $175 million and we spent about $80 million on bonuses," McDonnell explained. "I mean, it really worked well - private sector incentives to get people to conserve and save and be more efficient."

In fact, McDonnell's policies worked so well that six months after taking office, the new governor announced that Virginia would finish the fiscal year with a $403 million surplus.

"You've got to bring in great private sector initiatives and be efficient and then spend well on those things that government is supposed to do and then let the churches, the synagogues, the private sector, the benevolent organizations, the rest of our great institutions and society - let them do the work that they are appointed to do," he explained.

The private sector seems to like the climate. Since McDonnell took office, Virginia has added nearly 68,000 jobs. His administration has had a personal hand in attracting nearly 16,000 of them and at 6.8 percent, Virginia has one of the lowest unemployment rates in the nation....

In his new budget released last month, McDonnell is cutting or re-programming nearly $200 million. And in a controversial move, he's asking state employees to contribute to their pension plans, which will result in a pay cut.

He's also working to pull Virginia out of the liquor business by privatizing liquor stores owned and run by the state - a market the Commonwealth took over after prohibition. McDonnell wants to pour the savings into Virginia's aging transportation system.

"We want a performance-based budget," he said. "We don't want to just feel good putting money into things; we want results. And that's what people expect out of government, more results for less money. And that's the track we're on."

It's a track toward more conservative policies that McDonnell says have a proven record for prosperity."

Big Government sucks: EU bans herbal remedy competition to pharmaceutical companies

Pharmaceutical interests wins in Big Government Europe. Many like Big Government so that Big Government can regulate Big Companies. But just the opposite just happened in the EU. Here is Daniel Hannan's exposing of this destruction of local solutions and competition via Big Government regulation at the expense of possible natural remedies for the sake of Big Pharmaceutical. All this against the will of the people at the tax payer's expense of those same people. Unbelievable. Big Government sucks...who but knows that there is a natural remedy to issues we have that may be much less expensive than pills? Apparently, the answer to that question will not be coming from Europe if the EU continues to have its way.

I thought this video from 1976 Nobel Prize winner for economics applied here.

I would just add and tweak Friedman's argument that it is not greed that the world runs on. If it were all would come apart. Actually the countries that are productive tend to reward productivity. And if a country is responsible with its profits produced by productivity than that country has more to invest in the future with and become more profitable and productive. See these principles laid out in Matthew 25:14-29 as Jesus describes how his country is to be ran.

I would also add that the nation whose God is the Lord will tend to be more responsible, productive and therefore profitable. This our forefathers believed and many presidents after them. See One nation under God and what does it matter? and Cartoons and charts exposing economic consequences for America's straying from our "In God we trust" roots and label American Remembrance. It is no accident that the free market came to fruition under a largely Christian and Protestant nation believing in the priesthood of all believers that whether we eat or drink we are to do so to the glory of God let alone to be productive. See BBCNews: Communist China is currently studying protestant Christianity for secrets to economic success and Chinese President Hu Jintao added the word "religion" to the communist party constitution!!

President Reagan once said at a prayer breakfast in Dallas: "America needs God more than God needs America, If we ever forget that we are One Nation Under God, then we will be a Nation gone under."

Unborn baby dies as tax payer funded New York City workers purposely plan slow response to snow plow to protest budget cuts

On this on New York City tax payer's dime.

Via GateWay Pundit in article titled NY City Workers Planned Their Slow Response to Record Snowfall As a Protest to Budget Cuts

“They sent a message to the rest of the city that these particular labor issues are more important,” said City Councilman Dan Halloran (R-Queens), who was visited yesterday by a group of guilt-ridden sanitation workers who confessed the shameless plot.

Halloran said he met with three plow workers from the Sanitation Department — and two Department of Transportation supervisors who were on loan — at his office after he was flooded with irate calls from constituents.

The snitches “didn’t want to be identified because they were afraid of retaliation,” Halloran said.

“They were told [by supervisors] to take off routes [and] not do the plowing of some of the major arteries in a timely manner. They were told to make the mayor pay for the layoffs, the reductions in rank for the supervisors, shrinking the rolls of the rank-and-file.”

Among the victims of this crime: A newborn baby died after waiting nine hours for paramedics to arrive.

Here is a piece from HotAir.com to check out also at post titled Revolt: NY City Council members rip Bloomberg over snow removal, vow to hold hearings

And here is a video of the City workers damaging a tax payer's car at that tax payer's own expense via YouTube with 2.2 million hits since 12/27/2010. The original video embedding has been turned off so this another video with only 6 thousand views. Here is link to original video I believe. Warning: when New Yorkers get upset they cuss some. I don't mind the cussing so much as using the name of God in vain.

Green Europe feeling the cold: Largest windfarm of its kind in Scotland relying on Nuclear power in France and England's Green boilers can't take the cold

Gateway Pundit as these two posts today reporting on just how well green products hold up under pressure.

In the first post titled GREEN DISASTER: New Condensing Boilers Can’t Take the Cold – Thousands Freeze Up in UK

"The record freeze in Great Britain is causing tens of thousands of the new green condensing boilers to freeze up and shut down. Yorkshire alone experienced 60,000 call-outs to the plumber already."

This is good for the plumbing business however

"‘We’ve had double the number of call-outs as in the same period last year,’ says Charlie Mullins, MD of Pimlico Plumbers in London, the country’s largest independent plumbing company.

‘It is a massive problem. Some customers were ready to move out because their condensing boilers broke. If I had a choice, I’d put in a non-condensing boiler every time.’

It’s all the more infuriating because the problem causing these breakdowns is so simple. In cold weather, the pipe that takes waste water from the back of the condensing boiler – which isn’t there in a normal boiler – freezes solid, shutting down the system and in many cases causing permanent damage.

But this problem is just one of many that have plagued this boiler design since they became popular in the Nineties. Many plumbers consider them to be little more than a multi-billion-pound con-trick."

And in Scotland the wind farm is freezing. This from a post titled GREEN SCOTLAND Relies on French Nuclear Power During Deep Freeze

"SCOTLAND’S wind farms are unable to cope with the freezing weather conditions – grinding to a halt at a time when electricity demand is at a peak, forcing the country to rely on power generated by French nuclear plants."

Free speech victory for silenced pro-life Calif. student: Judgment ends lawsuit against K-8 school

Free speech victory for silenced pro-life Calif. student

Judgment ends lawsuit against K-8 school

FRESNO, Calif. — In a victory for pro-life speech in public school, a federal court entered a judgment Thursday against a California elementary school and three school officials for violating the First, Fourth, and Fourteenth Amendment rights of a 6th grade student who wore a T-shirt opposing abortion.

Los Angeles attorney William J. Becker, Jr., of The Becker Law Firm, assisted by the Thomas More Law Center, filed suit after school officials barred Tiffany Amador from wearing her pro-life T-shirt at McSwain Union Elementary School, a kindergarten through 8th grade school located in Merced, north of Fresno.

“This judgment represents a victory for the right to speak out against abortion,” said Becker.  “Public school students are not forbidden from proclaiming the value of life under the First Amendment.  The school has done the right thing by avoiding a trial and allowing a judgment to be entered in favor of this student on all claims.  All Americans, no matter their age, are free to exercise their constitutional right to speak out against the barbarism of on-demand abortion, and that includes public school students who do so in a non-disruptive manner.”

On April 29, 2008, Amador wore a shirt sponsored by the American Life League, an organization opposed to abortion and that annually sponsors a National Pro-Life T-shirt Week.  The shirt, which was given to her by her church, prominently featured the word “ABORTION” over a series of panels, two of which depicted endoscopic pictures of a baby developing in the womb and the third filled in with black.  The caption read, “growing…growing…gone.”  Amador testified in the case that she wore the shirt to school because she wanted other students to known that “abortion is wrong.”

The school claimed the images of the baby were “disruptive” to the school environment because of their “graphic nature” but could not explain what made them so graphic that they would have caused any disruption, much less a substantial one, as the U.S. Supreme Court has held is required before a school can infringe upon a student’s expressive rights.

In addition to claiming that her First Amendment right of expression was violated, Amador, who has since graduated from the 8th grade, alleged in the lawsuit that her Fourth Amendment right to be free from unreasonable search and seizure was violated when the school’s secretary forcefully pulled her into the principal’s office because of her T-shirt.

“Public school employees work for the government,” Becker said.  “Any time a school official uses physical force to suppress non-disruptive student expression, the government has gone way too far in enforcing its own political views.”

The lawsuit also sought vindication of Amador’s 14th Amendment right of equal protection.  The judgment was entered on all claims.

“Student speech at all grade levels is protected by the First Amendment,” Becker said.  “With few exceptions, such as profanity and lewdness, the Constitution prohibits school officials from picking and choosing what messages they find acceptable and what messages they find unacceptable.  The message of the shirt was that life demands respect. This is a particularly vital message for vulnerable young girls.  The pictures conveyed a message that could not be misunderstood, and that frightened school authorities, who are left without meaningful guidance as to what students can and cannot say.  Perhaps they will be less prone to trampling a student’s rights.”

Becker, who is litigating a similar case in Morgan Hill, Calif., involving students who were ordered to remove their American flag T-shirts on Cinco de Mayo, was assisted in the case by attorney Rob Muise of the Thomas More Law Center

Huckabee sweeps Romney and Palin amongst Moderate, Conservative and Tea Party Republicans in latest CNN poll

This from HotAir.com in an article titled CNN poll: The GOP’s got a fee-vah and the only prescription is more Mike Huckabee!

"It’s no surprise that Mitt and Huck do much better with self-described moderate Republicans than Palin does (fully 50 percent say they’re not likely at all to support her), but they actually outperform her among conservative Republicans too. Romney’s numbers are only slightly better but Huckabee’s are dramatically so — a combined 74/25 split among those who say they’re likely/not likely to support him versus a 62/37 split for Romney and a 58/41 split for Palin."

But it even gets better for Huckabee as he sweeps in the moderate Republican category, conservative and even the Tea Party category.

"The tea party numbers are fascinating too. Here’s how they break down for Palin:

And for Romney:

And for Huck:

Your money at work: Tax payers funding "Web based sex diaries" of homosexual as young as 16 year olds

From CNSNews.com in an article titled U.S. Government Funded Study Establishing 'Web-Based Sex Diaries' for Gay Males As Young as 16...

"The National Institute for Allergy and Infectious Disease (NIAID), a division of the National Institutes of Health (NIH), has awarded $126,000 over the past two years to a University of Washington study that established "web-based sex diaries" for gay males as young as 16.

By the time the grants end in 2011, taxpayers will have spent more than $250,000 for the study.

“The study's second aim is to assess the feasibility of using web-based sex diaries to collect sexual behavior data and to identify the appropriate diary schedule. MSM [men who have sex with men] will be randomly assigned diary schedules and we will compare the frequency of reported behaviors across diary schedules and against the retrospective questionnaire data,” the grant abstract states.

The study, titled “The Importance of Early Sexual Experiences Among Men Who Have Sex with Men,” seeks to find out if the circumstances under which young homosexuals first engage in homosexual acts impacts their future sexual behavior...."

Hawaii's new Governor wants to get more proof of Obama's birth place to put the issue to rest finally

It is about time!!! Check out the conclusion of Chris Matthews and his three journalists. Finally, they get it...after having to endure all the slander they spew out. It is not about a conspiracy but rather transparency. See the argument below video that Values Voter News has maintained since pretty much day one it has reported on this issue.

Visit msnbc.com for breaking news, world news, and news about the economy

From post titled Video: Memo from the Congressional Research Service of the US Congress admits no one in the federal government verified Obama's long-form birth certificate.

The last post on this issue was titled Steve Pearce and President Obama's original birth certificate that not even FactCheck.org, Snopes.com nor PolitiFact.com have been able to obtain. and so it appears we can add our current Government to the list of those who have yet to verify our President's original birth certificate.

"The analysis by the Congressional Research Service, a research arm of the U.S. Congress, openly admits no one in the federal government, including Congress, ever asked to see Obama's long-form, hospital-generated birth certificate. It explains no one was required to do so."-wnd.com.

I will just recopy the same argument that Values Voter News has been making for some time now that argues why this issue has yet to go away. Values Voter News asks those skeptical of "birthers" to have an openness of mind for a moment. Below are THE FACTS that many news sites seem to ignore. It is a very simple argument and easily verifiable and gives a rational reason why an 08/2010 CNN poll showed only 42% of Americans believe Obama was born in the US and it has nothing to do with race (Video: Chris Matthews reports that only 42% of Americans believe Obama was born in the US according to a new CNN poll. So why do Americans have this view?).

Here we go and it is quite simple:

To the left above is the Certificate of Live Birth that our President posted on his site as proof that he is a natural born citizen.

Fact 1: The Certificate of Live Birth that Obama posted on his web site being a "copy" proves there is an "original birth certificate/vital records". This naturally led many to seek the original to evidence forth the copy.

Fact 2: Dr Fukino states she verified the existence of the "original birth certificate/vital records" in '08. This naturally led many to seek to know what the "original birth certificate/vital records" actually read.

Fact 3: Dr Fukino states she has verified what is said on the "original birth certificate/vital records" namely that Obama is born in Hawaii and is a natural born citizen in '09. This is naturally leading many to want to see it for themselves or to have further verification by more than one.

Fact 4: The Obama Administration has yet to release those documents to the public or anyone else as far as we know nor has Dr Fukino. This is naturally leading many to question why.

Fact 5: So the best evidence we have of Obama's natural born citizenship via his original birth certificate/vital records to date is the statement by Dr Fukino.

Now wherever you stand on this issue is up to you. These are the facts. If Dr Fukino's word is good enough for you and you think her word should settle this issue then fine. But none the less at least be understanding of those who seek better evidence when it is available to seek.

So now the obvious and fair question that Big Media and those on the left on this issue are ignoring is: Why not release the evidence? This is not about a conspiracy but rather transparency. Why not release the information to the public or to a non-partisan independent group of some sort or to respected members of both sides to verify? Is it really enough to go on this Dr's word?

So in conclusion what is at base from the perspective here at Values Voter News that is fueling the fire of this controversy is the Administration's and Big Media's inability to put out the flames by actually fanning those flames themselves by:

#1) not asking the right question of the Obama Administration which is: Why not release the original birth certificate/vital records that Dr Fukino has confirmed exists that according to her proves Obama's natural born citizenship?

#2) whenever the issue is brought up by a better informed/understanding of the issue media the Obama Administration continues to fan the flame by failing to answer the above question by continually pointing to the birth certificate they produced online which totally skirts the question.

#3) Big Media only repeats what the Administration set forth in their answer and refuses to seek the best evidence available that is known to exist.

So if Big Media and the Obama Administration want this to go away then they can take some steps forward by 1) asking and understanding the right question then 2) answering the question and 3) to seek and reveal the best evidence that exists.

Again it's about transparency not conspiracy and seeking the best possible evidence when known to exist.

Click here to hear “America’s historian” speak about the lasting significance of Washington’s crossing of the Delaware 234 years ago.

From USHistory.org...

"In the winter of 1776, General George Washington and his ragged army had experienced only defeat and despair. The War for Independence was going badly, with failure following failure. In the preceding months, Washington's campaign in New York had not gone well; the Battle of Long Island ended in a loss when the British troops managed to out-maneuver the Continental Army. A series of defeats settled around Washington as he was forced to retreat across New Jersey to Pennsylvania on December 7th and 8th.

As the harsh Pennsylvania winter set in, the morale of the American troops was at an all time low. The soldiers were forced to deal with a lack of both food and warm clothing , while Washington watched his army shrink due to desertions and expiring enlistments. Now, more than ever, a victory was desperately needed.

The original plan called for the three divisions to cross the river under the cover of darkness. The boats to be used for the crossing were gathered earlier in the month in compliance with General Washington's orders, primarily as a defensive measure. Various types of boats were collected; most notable were the large, heavy Durham boats used to carry pig iron down the Delaware.

Fully expecting to be supported by two divisions south of Trenton, Washington assembled his own troops near McConkey's Ferry in preparation for the crossing. By 6 PM. 2,400 troops had begun crossing the ice-choked river. The operation was slow and difficult due to the condition of the river. There was an abrupt change in the weather forcing the men to fight their way through sleet and a blinding snowstorm. These obstacles proved to be too much for the supporting divisions led by Generals Cadwalader and Ewing, ultimately preventing their crossing at southern points along the Delaware.

Against all odds, Washington and his men successfully completed the crossing and marched into Trenton on the morning of December 26, achieving a resounding victory over the Hessians.

By moving ahead with his bold and daring plan, General George Washington re-ignited the cause of freedom and gave new life to the American Revolution.

Washington Crossing Historic Park was founded in 1917 to perpetuate and preserve the site from which the Continental Army crossed the Delaware River. This purpose is achieved by interpreting the historical significance of this site for thousands of Park visitors each year through tours, exhibits and various special events. The spirit of the 1776 Crossing is recreated every year on Christmas Day when the annual reenactment of Washington Crossing the Delaware takes place on December 25. In this annual reenactment the visitor can see reenactors in Continental military dress cross the river in the replica Durham boats.

But that isn’t all! Washington Crossing Historic Park also preserves and interprets the early 19th century history of Taylorsville, the area in which the crossing of the Delaware occurred. This small ferry crossing of the 18th century developed into a quintessential village of the next era, reflecting progress, American ideals and the new industrial age. As the Delaware Canal came through, a fully fleshed out community bravely looked to the future while remembering its past."

“The rules package we have offered represents a first step towards delivering on the pledge Republicans made to address Americans’ top priorities: cutting spending, creating jobs, and reforming the way Washington works.  These reforms will truly change the way Congress operates – increasing openness, deliberation and efficiency.  Republicans built our by listening to the American people, and these proposed reforms will help restore the institution, restore it to being the People’s House.  It’s not about us; it’s about them.  The American people want a smaller, less costly, more accountable government, and I look forward to working with my colleagues to institute these changes, fix this broken institution, and deliver on our pledge to them.”

Unborn child survives mother's swine flu induced coma

How is this for some Christmas cheer from The Christian Institute out of the UK.

Pregnant mum awakes from swine flu coma, baby alive

The family of a swine flu coma victim feared they may have to choose between saving her or her unborn boy, but they are now rejoicing that both are on the road to recovery.

Fallon Devaney, 25, regained consciousness last night. After waking, she assumed she must have lost her unborn son.

But tears welled up in her eyes when a midwife let her listen to her baby boy’s heartbeat. She is five months into her pregnancy.

Relief

The baby’s father, 30-year-old David Bowler, said: “When Fallon woke from the coma she didn’t even think the baby was still inside her.

“But we told her it was and he was doing fine.

“Then the midwife came down and saw Fallon and let her listen to the baby’s heartbeat which was great but made her a bit teary.”

Stable

A hospital spokesman said: “She is no longer critical and is now stable.” Her relatives said they are “happy but still cautious” because she has yet to fully recover.

Miss Devaney, from Kirk Hallam in Derbyshire, was rushed to hospital last week after struggling for breath. Medics diagnosed her as suffering from swine flu.

She was placed in an induced coma in an attempt to save her and her baby’s life but she went on to develop pneumonia.

Agonising

At one point Miss Devaney’s family were told they might have to choose to induce the baby boy, risking his life, in order to save hers.

But thankfully she regained consciousness and the family are now optimistic that the baby will survive too.

She is still battling the illness in a Nottingham hospital.

Found memo of House Republicans requiring citation of Constitution on all new bills

Found the memo from Slate.com...

TO:       Members of the 112th Congress
Committee Staff Directors and Counsels; Member Staff

FR:       Speaker-Designate Boehner, Majority Leader-Elect Eric Cantor, Rules Committee Chairman-Elect David Dreier, Transition Team Chairman Greg Walden

DT:       December 17, 2010

RE:       New Constitutional Authority Requirement for Legislation

The Pledge to America released by House Republicans in September of this year included a commitment to “require every bill to cite its specific Constitutional Authority.” To implement this proposal, the Transition Team and the Elected Republican Leadership are recommending a change to standing Rules of the House to require that each bill or joint resolution introduced in the House be accompanied by a statement citing the specific powers granted to Congress in the Constitution to enact the proposed law.

As this requirement will apply to all bills and joint resolutions introduced in the 112th Congress — including those introduced on the first day — we are writing to provide early guidance for complying with this rule so as to minimize any disruption caused by its implementation. Our staff will also hold bipartisan briefings for your staff to assist in compliance with this new requirement.

TEXT OF THE PROPOSED RULES CHANGE:
The new rule will be a new paragraph of clause 7 of rule XII:
"(c) A bill or joint resolution may not be introduced unless the sponsor has submitted for printing in the Congressional Record a statement citing as specifically as practicable the power or powers granted to Congress in the Constitution to enact the bill or joint resolution. The statement shall appear in a portion of the Record designated for that purpose and be made publicly available in electronic form by the Clerk.”

COMPLIANCE WITH THE PROPOSED RULE:

When a Member presents a bill or joint resolution for introduction and referral (when it is dropped in the “hopper”), the bill must be accompanied by a separate sheet of paper citing the constitutional authority to enact the proposed bill or joint resolution. Below is the suggested format for the citation:

___________                                                                 Member Signature:____________________
(Bill Number)
CONSTITUTIONAL AUTHORITY STATEMENT
Pursuant to clause 7 of Rule XII of the Rules of the House of Representatives, the following statement is submitted regarding the specific powers granted to Congress in the Constitution to enact the accompanying bill or joint resolution.
______________________________________________________________________________ _____________________________________________________________________________.

The blanks are to be filled in by the sponsor. Below are five illustrative examples of citations of constitutional authority:
·         The constitutional authority on which this bill rests is the power of Congress to make rules for the government and regulation of the land and naval forces, as enumerated in Article I, Section 8, Clause 14 of the United States Constitution.
·         This bill is enacted pursuant to Section 2 of Amendment XV of the United States Constitution.
·         This bill is enacted pursuant to the power granted to Congress under Article I, Section 8, Clause 3 of the United States Constitution.
·         The Congress enacts this bill pursuant to Clause 1 of Section 8 of Article I of the United States Constitution and Amendment XVI of the United States Constitution.
·         This bill makes specific changes to existing law in a manner that returns power to the States and to the people, in accordance with Amendment X of the United States Constitution.
It is important to note that the sample citations above are merely examples. Further, the citation to accompany a bill is not limited to one sentence and a sponsor may provide additional explanatory details if they wish.

DETERMINING A BILL’S CONSTITUTIONAL AUTHORITY:
While the Office of the Legislative Counsel will assist Members by providing a properly formatted Constitutional Authority Statement form, it is the responsibility of the bill sponsor to determine what authorities they wish to cite and to provide that information to the Legislative Counsel staff.

In addition to the Constitution itself, there are a variety of resources available to Members and staff to assist them in identifying the power granted to Congress by the Constitution to enact a proposed bill. These include:

  • The Federalist Papers, written mostly by James Madison and Alexander Hamilton to explain the purpose of the Constitution, are considered by many to be the primary source of authority on what the Constitution was understood to mean when it was ratified. There are various editions of the Federalist Papers that provide useful commentary, including the Clinton Rossiter edition, which contains a useful copy of the Constitution with page references to the Federalist Papers that discuss those parts of the Constitution in the margins. The Federalist Papers are also available online at http://thomas.loc.gov/home/histdox/fedpapers.html
·         The Congressional Research Service’s “Annotated Guide to the Constitution” includes an outline format that allows users to select main topics, then scale down to more narrow subjects within the Constitution and relevant Supreme Court decisions. For House Members and staff, this information may be accessed through CRS’s website: http://www.crs.gov/analysis/Pages/constitutionannotated.aspx The Heritage Foundation has a variety of resources available for Members and staff, including the Heritage Guide to the Constitution, which provides a clause-by-clause analysis along with relevant court cases that is written for lawyers and non-lawyers alike. For more information visit: www.heritage.org.
  • The Founder’s Constitution is an on-line version of a five-volume work first published in 1986 that includes a range of documents that help explain and place into context the specific provisions of the Constitution. Information is arranged by article, section, and clause of the U.S. Constitution, from the Preamble through Article Seven and continuing through the first twelve Amendments. It is available at: http://press-pubs.uchicago.edu/founders/
  • There are a number of think-tanks and associations from across the political spectrum that provide research and commentary on constitutional issues, including:
The adequacy and accuracy of the citation of constitutional authority is matter for debate in the committee and in the House. The rule simply requires that the bill be accompanied by a constitutional authority statement upon introduction. The statement will be publicly available through the Congressional Record and will be available with other relevant bill information, such as a list of cosponsors, on the Thomas website.

FREQUENTLY ASKED QUESTIONS:

Q. What if a sponsor declines to attach a Constitutional Authority Statement when introducing a bill?

A. Under the rule, the clerk will not accept the bill and it will be returned to the sponsor. This is the same process used to enforce clause 5 of Rule XII, which since 1995 has prohibited the introduction of bills or resolutions which seek to designate a specific period of time (such as a day, week, or month) for a particular commemoration.

Q. Does this rule apply to the introduction of all bills and joint resolutions, such as bills that merely make technical corrections to current law or proposed constitutional amendments?

A. Yes, the rule applies to all bills and joint resolutions. In these instances, a sponsor may in their Constitutional Authority Statement wish to refer back to the power granted to Congress to enact the statute they are proposing to amend or the powers under Article V to propose constitutional amendments.

Q. Isn’t it the courts’ duty to determine whether a law is constitutional and thus doesn’t this rule infringe on the power of the courts?

A. No. While the courts have the power to overturn an Act of Congress on the basis that it is unconstitutional, Members of Congress have a responsibility, as clearly indicated by the oath of office each Members takes, to adhere to the Constitution.

Q. What impact will the Constitutional Authority Statement have on litigation regarding the constitutionality of Acts of Congress?

A. To the extent that a court looks at the legislative history of an Act, the Constitutional Authority Statement would be part of that history. However, the courts have made clear that they will not uphold an unconstitutional law simply on the basis that Congress thinks that the law is constitutional.

Q. What if the citation of constitutional authority is inadequate or wrong?

A. As stated earlier, the adequacy and accuracy of the citation of constitutional authority is a matter for debate in the committees and in the House. Ultimately, the House will express its opinion on a proposed bill, including its constitutionality, by either approving or disapproving the bill.

Q. So why have this Rule at all?

A. Just as a cost estimate from the Congressional Budget Office informs the debate on a proposed bill, a statement outlining the power under the Constitution that Congress has to enact a proposed bill will inform and provide the basis for debate.  It also demonstrates to the American people that we in Congress understand that we have an obligation under our founding document to stay within the role established therein for the legislative branch.
